Obtaining Fair and Just Compensation
When a person dies because of the negligent or reckless actions of another, filing a wrongful death lawsuit is generally something surviving family members don't think about doing right away. However, in many cases prompt action is required in order to fully investigate the circumstances surrounding the fatal accident and to preserve critical evidence that might otherwise be lost or destroyed.
At Clancy Law, we strive to give our clients the personal support they need to get through this difficult time in life, as well as the resources they will need to recover and rebuild their lives after the legal case is over. In cases involving wrongful death, the sooner we can begin to investigate the medical malpractice, or the car accident or whatever else may have caused your loved one's death, the better our chances will be to accomplish those goals.
Law firms in Illinois and other states have consistently chosen to refer especially complex and difficult cases to our attorneys because they are familiar with the quality of personal service here, and with the exhaustive preparation we put into every case.
Illinois' Wrongful Death Statute Has Changed for the Better
Before the state's Wrongful Death Act was amended in 2007 — grief, sorrow and mental suffering were not compensable losses. In practical terms, the way the law used to be written meant that there was often little or no justice for people who had lost minor children, retired husbands or wives, or other individuals who did not earn a significant income.
Now, eligible surviving family members have the right to be compensated for all of their losses, not just the economic ones.
