First Choice Bank, as Guardian ad Litem of the Estate of H______ J______, a disabled minor vs. Health Professionals, Ltd., Jeffrey Bargar, Deborah Goss-Johnson, Margarita Mendoza, Ariel Irban-Alacalay, Ron McLin, Sharon Parker, Willie Bailey, L. Pepper, Tina Mattera, MD and John Redwinski, Docket No: 08 CV 5017 (Northern District of Illinois-Eastern Div)

CLO represents the Estate of H.J., a now 17 year old child. H.J. had a troubled past and significant mental health disorders and was detained at the Illinois Youth Center-Warrenville ("IYCW) beginning in December 2006. Unfortunately, H.J.'s mental health condition deteriorated in February of 2007 and she displayed increasing tendencies towards self-harm. She eventually threatened suicide, and was placed on suicide watch. On March 13, IYCW employees concluded that H.J. was well enough to be removed from suicide watch, and H.J. attempted suicide the next day. H.J. is currently a resident of a rehabilitation clinic and will need twenty-hour care for the rest of her life as a result of the brain injury sustained in the suicide attempt. CLO has filed suit against both the employees of the Illinois Youth Center and Health Professionals, Ltd., a contractor who was providing medical and mental health to the inmates at the time of H.J.'s suicide attempt. The case is pending in the United States District Court for the Northern District of Illinois, Eastern Division and is currently in the midst of discovery.

Ty Ear, Special Administrator of the Estate of Siev Ear v. Gail Rousseau, MD et al, 09 L 6032 (Cook County)

Clancy Law represents the family of Siev Ear, a Chicago pharmacist who died in 2008 when she was only 30 years old, in this medical malpractice case. The complaint alleges that a surgeons negligently performed surgery to remove a benign pituitary tumor, tearing open a blood vessel in Ms. Ear's brain, and caused her death. CLO's experts contend that the imaging studies of Ms. Ear's brain following the procedure show injuries from the surgery to parts of the brain far away from the location the surgeons intended to go. Discovery is in the early stages and is moving forward.

Diane Watson, Special Administrator of the Estate of Mae Marie Donor v. Roger Habb, MD, Dekalb Clinic, Inc, et al, 10 L 15 (Dekalb County)

In Dekalb County, Clancy Law represents the children of Mae Marie Doner, an 85 year old woman who died in 2008 after Dekalb Clinic physicians failed to treat her promptly after blood tests revealed that she had a deadly MRSA infection. CLO contends that physicians waited several days after tests confirmed that Ms. Donor had virus before belatedly beginning treatment. Discovery in this case is just beginning.

Michael and Patricia Shannon v. Sherman Hospital et al, 10 L 65 (Kane County)

CLO has filed suit in Kane County against Sherman Hospital and others on behalf of Michael Shannon and his wife Pat. The complaint alleges that Mr. Shannon sustained an injury to an artery in his left wrist at Sherman as nurses were getting him ready for abdominal surgery. Unfortunately, that the injury went untreated until the blood flow to his left thumb had been so compromised that his left thumb had to be amputated. Depositions in this case should start soon.

First Choice Bank, Special Administrator of the Estate of Keith P. Forbes v. Marie Myriam Marot and Fraternite Notre Dame, Inc, 07 L 13973 (Cook County)

Clancy Law represents the parents and siblings of Keith Forbes, a 16 year old high school sophomore who was killed in an automobile crash in 2007. Keith was backseat passenger in a car driven by a friend and classmate which was broadsided in a Kane County intersection by a van driven by Marie Marot and owned by Fraternite Notre Dame, Inc. Witness accounts suggest that Ms. Marot ran a red light. Depositions are underway and the case should come to trial sometime in 2011.

Chelsea Mertz v. Onofrio J. Lorusso et al, 09 L 483 (Kane County)

CLO has filed suit on behalf of Chelsea Mertz, a recent graduate of St. Charles East High School. The complaint alleges that Mr. Lorusso lost control of the vehicle he was driving and in which Ms. Mertz was a passenger. The SUV struck a tree, killing a front seat passenger and severely injuring Ms. Mertz. Mr. Lorusso was charged with a variety of traffic offenses arising out the accident, including driving under the influence of alcohol, and was recently sentenced to some jail time and a lengthy period of probation. ( Chicago Tribune, Daily Herald) The case is headed to mediation at the request of the defendant's insurer in the late summer of 2010. If the case does not resolve at the mediation, it should be ready for trial by late 2011.
