Anna Cullen v. Premier Baths, Inc., United States District Court for the Northern District of Illinois docket number 11 CV 6393

Ms. Cullen, an 85 year old resident of Oregon, Illinois alleges that she was injured when the chain which was connected to the drain stopper on a walk in tub sold to her by Premier Baths broke. Ms. Cullen's complaint claims that she bought the tub after seeing a TV ad and had it installed by a contractor selected by Premier Baths. The second time she used the tub, she fell as she tried to sit on the seat and became wedged in the well of the tub which was partially full of water. Unable to free herself, she attempted to remove the drain stopper by pulling on the chain so that the water would drain from the tub. The chain broke at the point where it was connected to the stopper, leaving her trapped in the tub and water for hours. Ms. Cullen claims that she was hospitalized and underwent substantial rehabilitation to recover from injuries to her skin and feet.

Dominic and Rissa Bruno v. Joseph Kratochvil, Dekalb County Circuit Court civil action number

Mr. Bruno claims that his new year started poorly when the car he was driving was struck by a car driven by Mr. Kratochvil in a Genoa intersection on January 1, 2011. The complaint asserts that Mr. Kratochvil failed to stop for a stop sign at the intersection and that the resulting crash caused Mr. Bruno to need hernia repair surgery.

Sandra and David Lenox v. Mendota Museum & Historical Society, LaSalle County Circuit Court civil action number

Ms. Lenox's complaint alleges that she suffered a badly broken ankle needing surgical repair when she slipped and fell on an unnatural accumulation of ice on property owned and cared for by the MMHS which was located at the historic Mendota Metra station. Ms. Lenox was on her way to the station to pick up her sister, who was arriving for a visit by train.

Martin Ferraro, Special Administrator of the Estate of Mariann Ferraro v. Resurrection Senior Services d/b/a Ballard Nursing Center, Cook County Circuit Court civil action number 11 L 6306

Mr. Ferraro, the surviving husband of his late wife Mariann, filed a complaint in Cook County against a nursing home where Mariann stayed prior to her death. The complaint alleges that the nursing home staff failed to watch Mariann closely enough and failed to respond in timely way to her need to use the bathroom. As a result, Ms. Ferraro tried to walk to the bathroom on her own, fell, and suffered a serious ankle break which required surgery and contributed to her death.

Additionally, Judy Schutter's pharmaceutical products liability case against Wyeth Pharmaceutical (Schutter v. Wyeth, United States District Court for the Northern District of Illinois civil action number 05 CV 998) has been set for trial. Ms. Schutter's complaint contends that Wyeth's hormone replacement therapy drug Prempro either caused or accelerated the growth of her hormone-receptor positive metastatic breast cancer. The trial, which is expected to last about three weeks, is scheduled to begin January 30, 2012 before the Honorable Blanche Manning. Ms. Schutter will be represented by Michael and Esther Berevofsky and Kevin Haverty, Williams Cuker Berevofsky, of Cherry Hill, New Jersey.
